1. Definitions

Consequently, evidence can only be provided by means of a written statement intended for that purpose; other written statements and witness statements concerning orally agreed amendments or amendments through other conduct are excluded as means of evidence;

english The Consumer, or the natural person(s) or legal entity/entities to whom Leka Trading B.V. makes an Offer for the supply of Products and/or with whom Leka Trading B.V. enters into an agreement;

english a consumer as defined in Article 6:230g, paragraph 1, sub a of the Dutch Civil Code;

 

english Consumer Agreement

english a contract between Leka Trading B.V. and a Consumer;

 

english Product(s)

english The Products to be delivered/delivered or leased/leased by Leka Trading B.V. to or for the Customer;

 

english Leka Trading B.V.

The private limited liability company Leka Trading B.V.,

english acting under the name Leka Trading B.V.;

 

English Agreement

english every contractual agreement that is concluded between Leka Trading B.V. and Customer, including any amendment or addition thereto, as well as all preparatory and executive (legal) actions thereof;

 

Price

english The compensation that the Customer owes to Leka Trading B.V. for

english the delivery of Products, excluding VAT and other

english government levies, unless explicitly stated otherwise;

Under 'recorded in writing' in these terms and conditions, it is also understood that

4. Prices

consequential damages, lost profits, missed savings, and

english 11. Force Majeure

 

english 11.1 In case of force majeure, english Leka Trading B.V. not held her

english 11.2 Force majeure means an attributable

shortcoming, including but not limited to strikes, fire,

natural disasters, government intervention, supply chain disruptions

english energy, water, and telecommunications, and equipment failure.

 

11.3 If the force majeure situation lasts longer than ninety (90) days

english continues, both parties are entitled to the Agreement to

english 12. Applicable Law and Competent Court

 

12.1 All Agreements shall be governed exclusively by Dutch law.

english Chapter 2: Additional Provisions for Consumer Agreements

 

english 13. Right of Withdrawal

 

english 13.1 The Consumer has the right to the Consumer Agreement

within a withdrawal period of 14 days without giving a reason

english reasons to dissolve.

 

english 13.2 The revocation period commences on the day after the Consumer or

a third party designated by the Consumer in advance, other than the

english carrier, the Product has received.

 

english 13.3 During the Withdrawal Period, the Consumer shall carefully

13.6 The costs for returning the Products are for

english 14. Exceptions to the right of withdrawal

 

english 14.1 The right of withdrawal is excluded for the following Products:

english a. Products that can spoil or age quickly;

english b. Products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;

english c. Products that by their nature are inseparably

mixed with other matters;

english d. Audio and video recordings and computer software

the seal of which has been broken after delivery;

english e. Newspapers, periodicals or magazines, with the exception of

subscriptions for this;

english f. Products manufactured in accordance with the specific instructions of the

Consumer;

english g. Products that are clearly of a personal nature;

english h. Products that by their nature cannot be returned.

 

english 15. Conformity

 

15.1 english Leka Trading B.V. english ensures that the Products comply with the

Agreement, the specifications mentioned in the offer, to the

english reasonable requirements of soundness and/or usability and the

english on the date of the conclusion of the Agreement

english applicable statutory provisions and/or government regulations.

 

15.2 A lack of conformity must be notified within a reasonable period after

english 16. Dispute Resolution
